Wendy M. Creeden is a partner in the Telecommunications Group of our Washington, D.C. office. Ms. Creeden has worked in the telecommunications field for more than 15 years, counseling wireline, wireless, satellite, broadband, Internet and specialty telecommunications service providers on a broad range of state and federal regulatory issues, from market entry strategies and regulatory compliance, to regulatory policy development and advocacy for traditional and emerging services.
Ms. Creeden practices before the Federal Communications Commission (FCC), state public utility commissions, and other federal and state regulatory agencies, and represents clients in enforcement, investigations, complaint, authorization, transactional, rulemaking, regulatory audit and appeal proceedings.
Ms. Creeden�s experience in the telecommunications field is extensive and includes particular emphasis in the area of universal service, counseling clients on all facets of federal and state universal service programs, including regulatory obligations and requirements related to high cost, low income, rural health care and E-rate support.
Ms. Creeden also regularly advises telecommunications carriers and other companies on legal issues related to compliance with federal and state privacy laws, including Customer Proprietary Network Information (CPNI), Carrier Proprietary Information (CPI) and Electronic Communications Privacy Act (ECPA). She counsels clients on subpoena compliance for release and disclosure of consumer information and advises companies in the development of marketing campaigns that comply with federal and state privacy laws and regulations.
·  Defends Universal Service Fund (USF) recipients and contributors in USF investigations and audits conducted by the Federal Communications Commission (FCC), Universal Service Administrative Company (USAC), Department of Justice (DOJ) and state public utility commissions
·  Advocates USF policy positions and prosecutes USF appeals before the FCC and USAC
·  Assists clients with navigating complex federal and state requirements related to USF assessments and reporting
·  Represents service providers in regulatory investigations and enforcement proceedings before federal and state regulatory agencies and attorney general offices
·  Counsels Voice Over Internet Protocol (VoIP) and other IP providers on the complex federal and state regulatory developments involving these emerging services
·  Advises clients on specialty service regulations, including pay-per-call (900), payphone, operator service, directory assistance, dial-around calling card and private carriage
·  Provides strategic advice on use of unlicensed spectrum for broadband and other wireless services, including counseling on technical service requirements and interference issues
·  Counsels clients on federal and state regulatory issues related to financing, mergers and acquisitions, and asset transfers
·  Counsels clients on marketing and billing compliance, including requirements under the Telephone Consumer Protection Act (TCPA), CAN-SPAM Act, slamming, cramming, third-party billing, truth-in-billing and federal marketing guidelines
·  Advises clients on compliance issues related to the wiretapping capability requirements of Communications Assistance for Law Enforcement Act (CALEA), including development of System Security and Integrity (SSI) manuals and subpoena compliance programs
·  Counsels clients on federal and state privacy law compliance in responding to government requests for consumer documents and information
·  Defends clients in Do Not Call Investigations by state and federal government agencies
·  Counsels clients on changes to telemarketing campaigns (telephone and text messaging) to comply with federal telemarketing laws, including Do Not Call, Telemarketing Sales Rule and FTC "robocalls" rule
·  Advises telecom communications companies on use of Automatic Number Identification (ANI), Calling Party Number (CPN), Calling Party Name and Billing Name and Address (BNA) in compliance with federal regulations
