Franklin B. Velie is a partner in the Litigation group of our New York office.

His practice encompasses a broad range of commercial matters, including securities, products liability, white-collar criminal defense, domestic and international arbitration, employment law, accountants’ and auditors’ liability, insurance and bankruptcy.

Franklin has tried over 50 jury and non-jury trials and arbitrations in jurisdictions throughout the United States. He has served as an arbitrator and mediator. He previously served as an Assistant U.S. Attorney for the Southern District of New York and was Assistant Chief of the Criminal Division of that office.

Throughout a distinguished career, he continues to be highly sought after for his wealth of experience, which includes the representation of: a European bank in Madoff litigation, obtaining the dismissal of a $60 billion RICO claim, a $6 billion fraud claim, and – on behalf of all of the foreign banks and service providers sued by the Madoff Trustee – he  obtained dismissal (at the District Court level) of clawbacks of payments made to these parties outside the United States

With such a high stature, he has advised on a raft of high-profile cases, including acting as federal prosecutor in the National Student Marketing Case (U.S. v. Natelli), a leading case involving issues of accounting and auditing fraud. He was also a key member of the national trial team that advised Owens Corning in connection with asbestos litigation and represented Santa Fe Natural Tobacco Company in litigation challenging a statute outlawing cigarette sales through the internet. In other matters, her represented Assicurazioni Generali in the successful defense of World War II-era claims, described by claimants’ counsel as in excess of one billion dollars.

He regularly acts for persons in investigations by the U.S. Attorney’s Office, the New York State Attorney General, and the SEC, and much more.

Representative Client Work

  • Represents a European bank in Madoff litigation and obtained dismissal of a $60 billion RICO claim, a $6 billion fraud claim, and on behalf of all of the foreign banks and service providers sued by the Madoff Trustee, obtained dismissal (at the District Court level) of clawbacks of payments made to these parties outside the United States
  • As a federal prosecutor, tried the National Student Marketing Case (U.S. v. Natelli), a leading case involving issues of accounting and auditing fraud
  • Represented a major pharmaceutical company in a successful international arbitration involving a distribution agreement and in litigation involving ownership of a drug in development
  • Represented a major New York bank in connection with litigation involving a construction delay with respect to its office tower in Manhattan
  • Represented Owens Corning and was on its national trial team in connection with asbestos litigation
  • Represented Santa Fe Natural Tobacco Company in litigation challenging a statute outlawing cigarette sales through the internet
  • Represented an employee benefits consultancy in a dispute with a big four accounting firm over entitlement to rights to sales proceeds upon sale of the consultancy by the accounting firm
  • Regularly represents persons in investigations by the U.S. Attorney’s Office, the New York State Attorney General, and the SEC
  • Represented Assicurazioni Generali in successful defense of World War II era claims, described by claimants’ counsel as in excess of one billion dollars
  • Represented a maritime insurer in successful defense of claims for insurance coverage relating to several hundreds of millions of dollars of claims for asbestos related illness
